2 October 2003 (1)
(Failure of a Member State to fulfil its obligations - Failure to transpose Directive 93/15/EEC)
In Case C-89/03,
Commission of the European Communities, represented by L. Ström and B. Stromsky, acting as Agents, with an address for service in Luxembourg,

THE COURT (First Chamber),
composed of: M. Wathelet, President of the Chamber, P. Jann and A. Rosas (Rapporteur), Judges,
Advocate General: D. Ruiz-Jarabo Colomer,

8. Under Article 69(2) of the Rules of Procedure, the unsuccessful party is to be ordered to pay the costs if they have been applied for in the successful party's pleadings. Since the Commission has applied for costs to be awarded against the Grand Duchy of Luxembourg and the latter has been unsuccessful, it must be ordered to pay the costs.
On those grounds,
THE COURT (First Chamber),
hereby:
1. Declares that, by failing to bring into force the laws, regulations and administrative provisions necessary to comply with Council Directive 93/15/EEC of 5 April 1993 on the harmonisation of the provisions relating to the placing on the market and supervision of explosives for civil uses, the Grand Duchy of Luxembourg has failed to fulfil its obligations under that directive;
