Summary:The Senior Investigator varied the Department's decision. He affirmed, under section 15(1)(a) of the FOI Act, the Department's refusal of records containing details of complaints made by Ukrainian refugees, on the basis that it does not hold such records and is not required, under section 17(4) to create them. However, he annulled its decision, under section 35, to refuse to release details of anonymised complaints made by International Protection applicants, and directed their release.
