Att. Gen. v Bhojwani 2010 JLR 1 (11 April 2008)


Criminal Procedure-prosecution case-disclosure of relevant information-prosecution to disclose anything considers (i) relevant or possibly relevant to issue in case; (ii) raises or possibly raises new issue; or (iii) real prospect of providing lead on evidence under (i) or (ii)-if disagreement, disclosure determined by court-if prosecution denies abuse of process is issue (and thus refuses disclosure), abuse is issue only if defence raises conduct which court accepts reasonable grounds to suspect took place; had nature or character of abuse of process; and taken at highest could lead to stay of proceedings
