In re S Trust v 2011 JLR 375 (21 June 2011)

Trusts-trust assets-mistake by settlor/donor-voluntary distribution into trust set aside if court satisfied (i) mistake (of fact or law) by settlor/donor; (ii) settlor/donor would not have entered transaction "but for" mistake; and (iii) mistake so serious that unjust for donee to retain property-disposition set aside if mistaken belief (from incorrect advice) that would avoid significant adverse tax consequences-transaction voidable not void
