Trusts-trust assets-mistake by trustee-transaction set aside if court satisfied (i) mistake by trustee; (ii) would not have entered transaction "but for" mistake; and (iii) mistake so serious that unjust for donee to retain property-appointment of trust assets, incurring substantial inheritance tax liability because of settlor's early death, not set aside if trustee mistaken as to good health of settlor and failed to obtain life insurance but not unjust for donees (aware of settlor's health problems) to retain property
