Application to review refusal of Magistrates Court to grant bail on 10 June 1998.

On 31, March, 1998, the applicant reserved his plea to 1 count of robbery; and 1 count of having an offensive weapon ( a pocket knife ) in his possession without lawful authority of reasonable excuse, contrary to Article 27 of the Firearms (Jersey) Law 1956.

Remanded in custody; no bail option

On 20 April 1998, Not guilty pleas were entered to both charges. Bail refused.

On 29 April 1998, Bail refused

On 27 May 1998, Remanded in custody for trial before Royal Court. Bail refused.

On 10 June 1998, Bail refused

JUDGMENT

THE DEPUTY BAILIFF: Mr Dixon brings this application on the basis that there was a change of circumstances that the Magistrate did not take fully into account. We have carefully examined the transcript of the evidence and we can see that the two matters were clearly before the Magistrate when he made his decision which was that he had heard everything that had been put to him before on several occasions; that the change of circumstances were not such as to make him change his mind and therefore that he would refuse bail.

Our duty on an application for bail is to examine whether the Magistrate may have erred in any way but we would perhaps go further than that and include the seriousness of the offence.

The statement that we have read - and we appreciate that the accused has not yet been presented in this Court - and the record which has been shown to us, leave us in no doubt that bail is to be refused and on that basis, Stevenson, you are remanded in custody until you are indicted.
