ROYAL COURT
(Samedi Division)
10th February 2006
Before : |
F. C. Hamon, Esq., OBE, Commissioner, and Jurats Tibbo and Allo. |
The Attorney General
-v-
Michelle Bernice Ahier
Sentencing by the Inferior Number of the Royal Court, following a breach of probation.
S. Sharpe, Crown Advocate.
Advocate R. Tremoceiro for Ahier.
JUDGMENT
THE Commissioner:
1. You were given a chance last time, you know that, and what the Deputy Bailiff said to you, That was at the last hearing. That's what he said.
2. We know you don't like prison, and normally what would happen in these circumstances, because you are in breach, you would go to prison for the original sentence, which was a serious offence, for 15 months.
3. You are making efforts; we understand that, we understand that you are, at the moment, drug free. We have analysed, as carefully as we can, all the alternatives. You have to go to prison, but we're not going to send you to prison for the long period that you deserve. You are going to go to prison for 3 months. Now in that 3 months you have got to take control of the situation, you have got to listen to Mr Gafoor, you have got to take whatever is given to you, and we hope that the Church will be able to help you during this time and we hope that when you come out, you will go to Wales and attend this course, because you have very serious problems. We don't want you to go on probation for a third time, because we don't think you will comply with it because you stop complying with things as soon as your mood changes. I know the circumstances are different; but you will have to stick it out for 3 months. During those 3 months efforts will be made on your behalf to try and help you because we want you to succeed.
