    DECISION ON A PRE-HEARING REVIEW

    The decision of the Tribunal is that the claimant is ordered to pay a deposit of £500.00 as a condition of being permitted to continue to take part in these proceedings as the Tribunal considers the contentions of the claimant have little reasonable prospect of success.

    Reasons for decision

  1. The claimant submitted an application form to the respondent in September 2000 for a post of Social Services Training Manager. He claimed by failing to be short listed he was discriminated on the grounds of race, religious belief and/or political discrimination and victimisation.
  2. The respondent denied his claim and said that he was not put forward for short listing as he had failed to complete the monitoring form which was attached to the application form.
  3. I have been shown the monitoring form and accept it states quite clearly that "failure to complete this section will result in your application being rejected". The claimant failed to complete Section 3 of the form.
  4. Accordingly I find that the contentions of the claimant in relation to discrimination and victimisation have little reasonable prospect of success. The Tribunal makes an Order against the claimant requiring a deposit of £500.00 as a condition of being permitted to continue to take part in the proceedings.
