The unanimous decision of the tribunal is that the applications for costs on behalf of the respondents and the claimants are dismissed.

The claimants were represented by Mr Brian McKee, of counsel, instructed by McCartan Turkington and Breen Solicitors.
The respondent were represented by Mr Michael Potter, of counsel, instructed by Walker MacDonald Solicitors.
1. A claim for religious discrimination on behalf of the claimants against the respondents was listed for hearing between 1 and 22 February 2013.
2. Reading days were scheduled for 1 and 4 February with the substantive hearing to begin on 5 February 2013.
3. On 5 February 2013 the claimants withdrew their claims and the claims were dismissed on 6 February 2013.
4. By letter of 8 February 2013 the respondents sought costs against the claimants for £30,000.00 under Regulation 35 of The Fair Employment Tribunal (Rules of Procedure) Regulations (Northern Ireland) 2005.
5. By letter of 22 February 2013 the claimants applied for costs of £9,000.000 against the respondents under Regulation 35 of The Fair Employment Tribunal (Rules of Procedure) Regulations (Northern Ireland) 2005.
6. Both applications for costs were heard on 8 March 2013.
7. Both parties made submissions to the tribunal in support of their application for costs and opposing their opponents’ applications for costs.
8. The tribunal decided not to award costs in favour of any of the parties and dismissed their respective applications for costs.
9. Oral reasons were given at the hearing.
