FAIR EMPLOYMENT TRIBUNAL
CASE REFS: 52/13 FET
827/13
CLAIMANT: Andrew Bell
RESPONDENTS: 1. Primark Stores Ltd
2. Brian McKeown
3. Neil Kirk
DECISION
The unanimous decision of the Tribunal is set out at Paragraph 1. below.
Constitution of Tribunal:
Chairman: Mr D Buchanan
Members: Mrs T Madden
Mrs D Adams
Appearances:
The claimant appeared in person and was not represented.
The respondent was represented by Mr J Kennedy, Barrister-at-Law, instructed by Pinsent Masons LLP, Solicitors.
1(i) The claimant’s claim of unfair dismissal is dismissed. He was still employed by the first respondent at the time of making his claim, having been reinstated in his employment. The Tribunal therefore does not have jurisdiction to determine his claim.
In any event, his claim of unfair dismissal was presented outside the prescribed time-limit for bringing such a claim, and the Tribunal refuses to extend time.
(ii) The claimant’s claims of discrimination on the grounds of his sex and of his religious belief are out of time, and it is not just and equitable to extend the time for bringing such claims.
2 Reasons were given at the hearing.
