Boal v Ferguson (t/a Atlantic Collection Agency International) (Breach of Contract) [2002] NIIT 1466_02 (5 December 2002)

    THE INDUSTRIAL TRIBUNALS

    CASE REF: 1466/02

    APPLICANT: Aliza Boal

    RESPONDENT: Joan Ferguson

    T/a Atlantic Collection Agency International

    DECISION

The unanimous decision of the tribunal is that the applicant's claim for breach of contract (in respect of unpaid wages) is well founded and it is ordered that the respondent shall pay the applicant the sum of £1,496.43 in respect of that claim.

    Appearances:

The applicant was represented by Mr Martin, Solicitor.

The respondent had not entered an appearance to the proceedings. Neither the respondent, nor any person acting on her behalf, was present at the hearing.

    REASONS

  1. These reasons are given in summary form.
  2. The tribunal received sworn oral testimony from the applicant.
  3. The applicant was employed as an office manager by the respondent. Her contract of employment lasted from March 2002 until 3 May 2002. At that stage, the applicant left her employment because of the respondent's persistent failure to pay wages.
  4. Upon the termination of her employment, the applicant was due payment of three weeks wages (nett pay of £498.81). The unpaid wages amounted to £1,496.43 in all.
  5. INTEREST

  6. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
