    THE INDUSTRIAL TRIBUNALS
    CASE REF NOS: 3170/01
    APPLICANT: Gerard Martin Kennedy
RESPONDENT: Lavelle & McAlinden Building Contractors
    DECISION

The unanimous decision of the Tribunal is that the applicant's claim is dismissed.

The parties were informed by Notice of Hearing dated 24 April 2002 that the case was listed for hearing on 5 September 2002. Neither party appeared and the Tribunal considered the written representations of both parties to date. There is not sufficient evidence contained in the originating application to sustain a claim of unfair dismissal in the circumstances that the respondent is denying that an unfair dismissal took place. Accordingly the Tribunal dismisses the application.
