    DECISION ON APPLICATION FOR REVIEW

    I hereby revoke the decision not to accept that part of the claim which relates to a complaint of unlawful discrimination on the grounds of sex and direct that that part of the claim presented to the tribunal on 5 April 2006 should be accepted.

    Reasons:

    Under Rule 34 of Schedule 1 of the Industrial Tribunals Rules of Procedure 2005, I find that it is in the interests of justice to deal with this matter by way of review. I am satisfied that the decision not to accept that part of the claim which relates to a complaint of sex discrimination should be revoked, because the allegation of sex discrimination appears to be an integral part of the decision to dismiss and I am satisfied that, in view of Regulation 6(5) of the Employment (Northern Ireland) Order 2003 (Dispute Resolution) Regulations (Northern Ireland) 2004, that the claimant was not required to invoke the grievance procedure.
