    DECISION

    The unanimous decision of the tribunal is that this application be dismissed in its entirety.

    The claimant did not appear and was not represented.

    The respondent did not appear and was not represented.

  1. The claimant in his claim to an Industrial Tribunal complained of unfair dismissal contrary to Article 126 of the Employment Rights (Northern Ireland) Order 1996 and in addition claimed entitlement to notice pay and holiday pay.
  2. The respondent denied that the claimant was dismissed and further denied that there was any entitlement to notice pay or to holiday pay.
  3. In the absence of the parties and their representatives the tribunal disposed of the proceedings under paragraph 27 (5) and (6) of Schedule 1 to the Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2005.
  4. The tribunal considered the claimant's claim and the response entered by the respondent.
  5. There was a clear conflict between the information contained in the claim and that given in the response to the extent that the tribunal were unable to make any findings on the issues.
  6. In all of the above circumstances the tribunal dismissed the claim in its entirety.
