DECISION ON AN APPLICATION FOR A REVIEW

I hereby revoke the Default Judgement of 23 April 2008 and give leave to the claimant to amend the title to the proceedings to substitute Travelbreak (NI) Limited as the first-named respondent instead of Travelbreak (NI).

The first and second-named respondents were not present. The third-named respondent was represented by Mrs Stringer.


Reasons


1. I accept in accordance with the overriding objective that the claimant’s application under Rule 33 of the Industrial Tribunals (Rules of Procedure) 2005 to review the Default Judgement dated 23 April 2008 should be considered by the tribunal and time is extended on a just and equitable basis to do so. I am satisfied that the first-named respondent should be Travelbreak (NI) Limited and not Travelbreak (NI) as stated in the Default Judgment. Accordingly, I revoke the Default Judgement and


give leave to amend the title to the proceedings to refer to Travelbreak (NI) Limited as the first respondent instead of Travelbreak (NI).
