    THE INDUSTRIAL TRIBUNALS

    DECISION

    The decision of the tribunal is that the claimant is entitled to a redundancy payment of £642.38.

    The respondent had not entered a response and was not present.

  1. The claimant was employed by the respondent from 1 September 2006 to 31 August 2008. She was initially employed on a 15 month fixed term contract which was then extended from time to time. She was given one months notice of redundancy due to the funding for the project on which she was working ending on 31 August 2008. The notice letter sent to the claimant indicated that her employment would terminate on 29 August 2008 which was a Friday.

  2. The claimant's terms and conditions of employment provide that wages are paid monthly in arrears three working days before the last day of the month. The claimant's salary for the month of August was paid into her bank account on

  3. September 2009 and did not show any deductions in respect on the 30 and 31 August.

  4. In these circumstances it is accepted that the claimant in reality remained in the respondent's employment until 31 August 2008. She has therefore been employed for the requisite period to be entitled to a redundancy payment.

  5. The claimant was born 2 July 1976. Her monthly wages were £1391.82 gross per month - £321.19 per week. The tribunal computed the redundancy payment as follows:-

    Total £642.38

    This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
