DECISION

The unanimous decision of the tribunal is that the claimant’s claims for unfair dismissal and breach of contract are dismissed.  The claimant was made redundant and is entitled to be paid a redundancy payment by the first respondent which the tribunal measures at £2960.00.

Constitution of Tribunal:

Chairman:                            Mr B Greene

Members:                             Mr B Irwin

The first respondent appeared in person and the second respondent was represented by Mr Peter Curran from Redundancy Payment Services.

1.         In open tribunal the claimant, following discussions with the LRA, withdrew his claims for unfair dismissal and breach of contract.  In the absence of any objection from the respondents the tribunal dismissed his claims for unfair dismissal and breach of contract.

2.         It was accepted by the first respondent that the claimant was made redundant by the first respondent; that he is entitled to a redundancy payment of £2960.00; and that the first respondent did not pay him his redundancy.

3.         Accordingly the tribunal orders the first respondent to make a redundancy payment of £2960.00 to the claimant.

4.         This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
