REASONS

 

1.               Under the Unfair dismissals legislation, a claimant usually has no right to be protected against unfair dismissal unless, at the date of dismissal, he has been employed by the respondent employer, under a contract of service, for a continuous period of at least a year.  In these proceedings, the claimant made a complaint in respect of his dismissal under the unfair dismissals legislation, alleging that his dismissal was unfair within the meaning of that legislation.  However, on 16 January 2012, we dismissed that unfair dismissal complaint, because, at the date of dismissal, the claimant had insufficient service, as an employee in the respondent company (“the Company”).

 

2.               In these proceedings, the claimant was also complaining under the Race Relations Order in respect of that dismissal.  In the context of that claim, he alleged that his dismissal was a racially discriminatory dismissal. (The claimant is Polish).  On 17 January 2012, a Director of the Company gave evidence which was relevant to the claim of discrimination.  After that testimony had been completed, the claimant withdrew his discrimination claim.  The legal consequence of that withdrawal is that the discriminatory dismissal claim is now dismissed.
