THE INDUSTRIAL TRIBUNALS
CASE REF: 910/12
CLAIMANT: Francis Lagan
RESPONDENT: JJ MacMahon (Building Contractor) Ltd
DECISION
The decision of the tribunal is that:-
(i) the respondent company do pay to the claimant the sum of £1,980.00 in respect of unpaid notice pay; and
(ii) the claimant is entitled to a redundancy payment from the respondent company on the basis of the information set out at Paragraph 3(ii) below.
Constitution of Tribunal:
Chairman (sitting alone): Mr D Buchanan
Appearances:
The claimant was represented by Mr J Morgan, Accountant.
The respondent company did not appear, nor was it represented.
1. I am satisfied that the respondent company had notice of these proceedings, and in reaching my decision I took into account the contents of its response.
2. The claimant worked for the company as a crane driver from 16 January 2007 until 1 May 2012 when he was made redundant. His wage was £396.00 per week.
3(i) I am satisfied that he is entitled to five weeks’ notice pay, amounting to £1,980.00, and I order that the respondent company do pay to him that amount.
(ii) At the time of his redundancy he was aged 63 and had worked for five full years. The appropriate multiplier is 71/2.
I am satisfied that he is also entitled to a redundancy payment of £2,970.00 (£396.00 x 71/2) from the respondent company.
4. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
