DECISION

The decision of the tribunal is that:-

 

(i)       the claimant is entitled to a redundancy payment of £399.57 from the respondent calculated on the basis of the information set out at Paragraph 2. below; and

 

(ii)      the respondent do pay to the claimant the sum of £399.57 in respect of unpaid notice pay.

Appearances:

The claimant appeared in person and was not represented.

The respondent did not enter a response, nor did he appear at the hearing.

 

1        The claimant confirmed that she was not bringing a claim of unfair dismissal.

 

2(i)     The claimant worked for the respondent from 5 January 2009 until 29 May 2012.  She was made redundant when the business closed.  She had three years’ complete service.

 

 (ii)     She was aged 35 at the time of her dismissal.

 

 (iii)     She earned £133.19 for a 22 hour week.

 

 (iv)     The appropriate multiplier for calculating her redundancy pay is 3.

 

 (v)     She is therefore entitled to a redundancy payment of £399.57.

 

3        She is entitled in a further payment of £399.57 in respect of unpaid notice pay (£133.19 x 3).

 

4(i)     The total amount payable is therefore £799.04.

 

 (ii)     She made verbal and written requests for the payment of this amount to the respondent.  He has not denied that it was payable, but has made no effort to pay it.

 

5        This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
