DECISION

 

1.         The notice pay claim against Solo Retailing Ltd (“the company”) is well-founded.  It is ordered that the company shall pay to the claimant the sum of £166 in respect of notice pay. 

 

2.         The claimant’s claim against Jonathan Finch (“Mr Finch”) is not well-founded.  Accordingly, that claim is dismissed.

The claimant was self-represented.

 

Both respondents were represented by Mr Finch.

 

 

REASONS

 

1.         During the course of this hearing, it became clear that both parties were now agreed that the claimant’s claim in respect of notice pay was well-founded, and that, pursuant to that claim, the claimant was entitled to £166.

 

2.         A notice pay claim can only be pursued against one’s employer.  It is clear that the claimant was employed by the company, and not by Mr Finch.

 

3.         This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
