The claimant appeared in person and was not represented.

The respondents did not appear, nor were they represented.

Mr N Cruickshanks, for Department of Employment and Learning.

 

1.       The title of the respondents was amended to that now shown above.

 

2.       The respondents entered a late response which was rejected, and they have not sought a review of that decision.

 

3.       The Department of Employment and Learning, which was originally a party to these proceedings, was dismissed as a respondent, with the consent of the claimant.

 

4        I am satisfied that the claimant, Mr Lennon, is an honest witness and on the basis of his evidence, I hereby order that the respondents pay to the claimant the following sums:-

 

(a)      a redundancy payment of £11,280.00 calculated on the basis that the claimant had 16 years’ complete service, was aged 57 at the time of his dismissal, and had a gross weekly wage of £800.00 (to which the statutory cap of £470.00 is applied).

 

                              The multiplier is 24 (24 x £470.00  =  £11,280.00);

 

                    (b)      a sum of £7,224.00 in respect of breach of contract

                              (12 weeks’ notice pay on a net weekly wage of £602.00); and

 

                    (c)      a sum of £327.09 in respect of unpaid holiday pay.

 

5.       This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
