The unanimous decision of the tribunal is that a Costs Order would not be granted in this case.

The claimant was represented by Mr Gerard O'Neill.

The respondent was represented by Mr P Smith, Barrister-at-Law, instructed by Bates Wells Braithwaite, Solicitors.

 

1. This matter had been listed for hearing for four days commencing on Tuesday 30 August 2016. After the first day of evidence the claimant's representative came off record at the start of proceedings on Wednesday 31 August 2016. Shortly thereafter the claimant withdrew her claim and it was dismissed.

 

2. The respondent applied by letter dated 28 September 2016 for costs in this matter.

 

3. After hearing submissions from both parties, the tribunal ruled, in an oral decision, with reasons given in that oral decision, that costs would not be awarded in this case.
