DECISION

 

 

(A)      The claimant's holiday pay claim against Blue Autumn Ltd ("the company") is well-founded and it is ordered that the company shall pay to the claimant the sum of £120 in respect of holiday pay.

 

(B)      The claimant's claim for notice pay against the company is well-founded and it is ordered that the company shall pay to the claimant the sum of £250 in respect of notice pay.

 

(C)     The claimant's redundancy pay claim against the company is well-founded and it is declared that the company is liable to make a redundancy payment of £1,860 to the claimant.

 

(D)     None of the claims against James Morley is well founded. Accordingly, all of those claims against James Morley are dismissed.

REASONS

 

  1. I announced my decision at the end of the hearing. At the same time, I gave brief oral reasons for that decision.

 

  1. I am satisfied that the proper title of the first named respondent is as specified above and the title of these proceedings has been amended accordingly.

 

  1. I am satisfied that it was not reasonably practicable for the claimant to present her holiday pay and notice pay claims within three months of the date of termination of her employment and that those claims have been brought within a further period which is reasonable.

 

  1. This Decision is based on the following information:

 

Gross weekly pay: £120

 

Net weekly pay: £120

 

Number of actual completed years of service: 13

 

Age on date of dismissal: 46

 

Multiplier (for redundancy pay): 15.5

 

  1. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
