DEFAULT JUDGEMENT

1.         The time for presenting a response having expired, the tribunal declares that the following complaints are well-founded:-

 

            (i)         failure to make a redundancy payment;

 

            (ii)        breach of contract (notice pay).

 

2.         I therefore order as follows:-

 

            (i)         The claimant is entitled to a redundancy payment calculated as follows:-

 

                        On the termination of her employment she had three full years’ completed service and was aged 59.  Her pay was £193.75 per week.

 

                        The appropriate multiplier for calculating her redundancy payment is 4.5.

 

                        Her entitlement is therefore:-

 

                                    £193.75 x 4.5 = £871.88.

 

            (ii)        The claimant by virtue of her service is entitled to two weeks’ notice pay at £193.75 per week.  I order that the respondent do pay to the claimant the sum of £387.50.

 

3.         This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
