DECISION

The decision of the Tribunal (Employment Judge Sitting Alone) is that:

 

1.            The claimant’s claim was lodged outside the relevant three month time limit specified by Article 145 of the Employment Rights (Northern Ireland) Order 1996 (as amended).

 

2.            The tribunal is not satisfied that it was not reasonably practicable for the complaint to be presented before the end of that three month period and refuses to exercise its discretion to extend the period for presenting the claim.

 

3.            The originating claim is therefore dismissed in its entirety.
