In the pursuit, at the instance of the heirs-portioners of Seaton of Blair against Sir A. Seaton of Pitmedden, the Lords found, on the 22d December 1674, that a brother nor no other in linea collaterali could be convened as successor titulo lucrativo post contractum debitum, but only he who was alioqui successurus necessario, and not only probabiliter. Anent Multure of Bear.
I saw a decision dated 3d July 1673, Oliphant against Oliphant, where the Lords found that bear behoved to pay multure, though it tholed not fire and water.
