The Sports Grounds and Sporting Events (Designation) (Scotland) Order 2010

The Scottish Ministers make the following Order in exercise of the powers conferred by section 18 of the Criminal Law (Consolidation) (Scotland) Act 1995(1) and all other powers enabling them to do so.

Citation and commencement

1. This Order may be cited as the Sports Grounds and Sporting Events (Designation) (Scotland) Order 2010 and comes into force on 10th June 2010.

Designation of Sports Grounds and Sporting Events

2. For the purposes of Part II of the Criminal Law (Consolidation) (Scotland) Act 1995 the following are designated:–

(a) the sports grounds specified in Schedule 1 to this Order;

(b) the classes of sporting events specified in Part I of Schedule 2 to this Order, at any of the sports grounds specified in Schedule 1 to this Order;

(c) the classes of sporting events taking place outside Great Britain specified in Part II of Schedule 2 to this Order.

Revocation

3. The Orders specified in Schedule 3 to this Order are revoked.

Extent

4. This Order extends to Scotland except that article 2(c) also extends beyond Scotland but, where it does so, it so extends only as a matter of Scots Law.

Article 2(b) and (c)

SCHEDULE 2 CLASSES OF SPORTING EVENTS

PART I

1. Association football matches in the Scottish Premier League.

2. Association football matches in the Scottish Football League.

3. Association football matches in the Scottish Highland Football League.

4. Association football matches in the competition for–

(a) the Scottish Football Association Cup;

(b) the Scottish Football League Cup;

(c) the Scottish Highland Football League Cup;

(d) the UEFA Champions League;

(e) the UEFA Europa League.

5. International association football matches in Scotland.

6. Association football matches (other than those specified in paragraphs 1 to 5 above) which come within the jurisdiction of the Scottish Football Association Limited.

PART II

Association football matches at a sports ground outside Great Britain in which one of the participating teams represents–

(a) the Scottish Football Association Limited; or

(b) a club which is a member of the Scottish Premier League; or

(c) a club which is a member of the Scottish Football League; or

(d) a club which is a member of the Scottish Highland Football League.

The Sports Grounds and Sporting Events (Designation) (Scotland) Order 2004(2).

The Sports Grounds and Sporting Events (Designation) (Scotland) Amendment Order 2007(3).

The Sports Grounds and Sporting Events (Designation) (Scotland) Amendment Order 2008(4).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order consolidates, with amendments, the previous Sports Grounds and Sporting Events (Designation) (Scotland) Orders.

The Order designates the sports grounds, the classes of sporting events played at those grounds and the classes of sporting events outside Great Britain for the purposes of Part II of the Criminal Law (Consolidation) (Scotland) Act 1995 (sporting events: control of alcohol etc.). This Order revokes the Sports Grounds and Sporting Events (Designation) (Scotland) Order 2004 and the subsequent Orders amending that Order.

The significant changes from the previous Order are the designation of football matches at three new grounds, namely–

(a) the Haughs, Turriff;

(b) North Lodge Park, Pitmedden; and

(c) Seafield Park, Grantown-on-Spey.

These additions reflect changes to football clubs which are members of the Scottish Highland Football League and the location of association football matches in that league.

The Order also makes changes to the classes of sporting events to update the names of the relevant football leagues and football competitions.
