The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 29(2) of the Human Tissue (Authorisation) (Scotland) Act 2019( 1).

Citation and commencement

1.  These Regulations may be cited as the Human Tissue (Authorisation) (Scotland) Act 2019 (Commencement No. 2) Regulations 2021 and come into force on 26 March 2021.

Appointed Day

2.  The day appointed for the coming into force of the Human Tissue (Authorisation) (Scotland) Act 2019, so far as not already in force, is 26 March 2021.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations are the second set of commencement regulations made by the Scottish Ministers under section 29 of the Human Tissue (Authorisation) (Scotland) Act 2019 (“the Act”) and bring into force the provisions of the Act, so far as not already in force, on 26 March 2021 (see article 2). The Act amends the Human Tissue (Scotland) Act 2006 to make provision about duties of the Scottish Ministers in relation to transplantation and pre-death procedures and in relation to the register. The amendments also make provision about the authorisation of removal and use of part of the body of a deceased person.

The commencement of sections 7 and 23 for all purposes has the effect of bringing into force the following regulations—

The Bill for the Act received Royal Assent on 18 July 2019. Sections 25, 26, 29 and 30 came into force the following day.
