MR JUSTICE MORISON (PRESIDENT): We are satisfied that the appeal is properly arguable at a full hearing having reviewed the decision of the Industrial Tribunal and the grounds of appeal. It seems to us that there are questions to be asked and answered about the competence of this decision.

In our view, this is a matter which deserves a Category A marking. It should be reserved to me. My colleagues who have spent some considerable time reading the papers in this case would wish to participate at the full hearing. I should make it plain that we of course have formed no view as to the ultimate outcome of this appeal, but we are of the view that it will require a day of argument and we shall be grateful for such assistance as we can receive from Counsel on both sides at that hearing. The Notice of Appeal does not require any amendment and I am satisfied that Notes of Evidence are not required in this case. The success or otherwise of this appeal must depend entirely on the written decision itself.
