JUDGE HICKS QC: On this appeal we have a letter from the solicitors to the Appellant indicating that it is not proposed that Mr Gray should attend or be represented here today. They ask us to consider the matter at this Preliminary Hearing on the basis the Notice of Appeal, already filed, and the arguments advanced in that letter itself. We have done so and consider that the appeal should go forward to a full hearing and we so order.
