    MR JUSTICE MAURICE KAY: Mr Healey we all think that you ought to be permitted to take your case to a final hearing.

    We think that the central issue is the one about Regulation 4(1)(a) and the form in which it was rejected by the Industrial Tribunal in paragraph 4.3 of its decision. We have considered whether we should not try to edit your grounds of appeal so that matters that are less arguable are removed at this stage, but in the context of the whole thing, we have decided to let the documentation stand to allow you to proceed on it. It is clear to us that you very sensibly accepted some advice this morning as to where to pitch your argument and where not, and we are confident that you will be equally receptive to that advice when you appear next time.

    We give you leave to take it to a full hearing.
