    JUDGE PETER CLARK: The Appellants case in this appeal has been fully pleaded in the Notice of Appeal. By their PHD form the Respondents accept that it raises a reasonably arguable point of law. Having considered the papers we consider that the appeal as constituted should proceed to a full hearing.

    The Appellants seek Chairman's notes of evidence of the witnesses Stuart Waller and Sandy Liddy. In their PHD form the Respondents accept that the appeal cannot be fairly determined without the Chairman's Notes. No additional evidence is sought by the Respondents, in their PHD form, accordingly we shall direct that the Chairman be asked to produce his notes of those two witnesses' evidence in full. We do so in circumstances where five of the grounds of appeal allege that material findings of fact by the Tribunal were unsupported by evidence or were inconsistent with evidence given and not rejected by the Tribunal.

    For the purpose of the full appeal hearing we shall direct that it be listed for one day, category B, there will be exchange of skeleton argument between the parties and copies lodged for this Tribunal not less than 14 days before the date fixed for the full appeal hearing.
