    LORD JOHNSTON: This is a preliminary hearing at the instance of Dr Anya, the appellant, in respect of his appeal against the finding of the Employment Tribunal in respect of his application to it to seek a finding that he was discriminated against on grounds of race in relation to his application for a post within the University.

    In the Notice of Appeal there are three main areas in which the appellant seeks to challenge the findings of the tribunal, which can be categorised generally as a failing on the part of the tribunal properly to have analysed and indeed determined upon certain crucial questions of fact upon which the whole case was based.

    For the purpose of this preliminary hearing we would simply adopt what is said in the Notice of Appeal in as much as we are satisfied in respect of each of the three heads put forward that there is a prima facie arguable case which should be heard at a full hearing and we shall so order.
