    MR JUSTICE CHARLES: This matter comes before us today for disposal. There was an Order made by the Registrar dated 15 April 1999, that unless a reply was received to letters stated therein within 7 days from the date of the Order the appeal will be set down for disposal. No replies have been received. There is no attendance today.

  1. The appeal is against a decision of the Employment Tribunal which was sent to the parties on 18 September 1998.
  2. Simply by looking at the index of the bundle one can see that that decision was reviewed and the reasons for that were sent to the parties on 16 December 1998. As we understand it, that review overtook the subject matter of the appeal and rendered the appeal redundant.
  3. This would explain why nobody has bothered to write to the Tribunal or do anything about the appeal. That is unfortunate. Parties who lodge appeals should withdraw them when it is no longer necessary for them to be pursued.
  4. However, in the circumstances we will simply dismiss this appeal.
