    HIS HONOUR JUDGE CLARK: This Appeal is listed for Preliminary Hearing before us today. Yesterday, a fax was received from the Appellants, stating that the Managing Director is unable to attend today due to a kidney infection. There is reference to him telephoning his office from hospital. We are asked to adjourn the Hearing. We do so with considerable reluctance. We have in mind the history of this matter and the claim by the Respondent's solicitor that this Appeal is simply a delaying tactic. Accordingly, we shall direct that within 21 days of this Order, Mr Buckley lodge a medical certificate showing that he was unfit to attend Court today and stating his medical condition. Failure to comply with this direction will result in the Appeal being dismissed without more. Subject to that, the case is to be relisted at the first available date. No further adjournment will be permitted in any circumstances. If for any reason, Mr Buckley is not available when the case is relisted he and his company must make alternative arrangements for representation on that day.
