    HONOUR JUDGE WILCOX:

  1. We consider that it is arguable that the Tribunal in this case were in error by deciding that the process in the absence of the Appellant, having given leave to permit a substantial counter claim out of time where issues of dishonestly were raised and the Appellant had attended the first stage of hearing and given evidence.
  2. We further consider that it is arguable that the Respondent erred in law is failing to grant a review having proceeded in the absence of the Appellant at the original hearing.
  3. We consider that those limited grounds should be investigated at a full hearing at the EAT.
  4. Category C - ½ day – skeleton arguments 14 days before the full hearing – full chronology.
