  1. Dr Mercer brought proceedings in the Employment Tribunal claiming direct discrimination and indirect discrimination. She succeeded in the proceedings and the Appellant, the London School of Economics, appealed from that decision.
  2. To all of us who read the decision and the skeleton argument in support of the appeal which is largely in the Notice of Appeal, it is clear that there is an arguable case. Mr Burke, who has appeared for the Appellant today, seeks to have the Chairman's Notes of Evidence of Professor Crafts, Professor Harlow, Mr Gregory and Dr Hurrell to be provided for the hearing of the Appeal. We will ask the Chairman to provide them.
  3. He has suggested that the Respondent may wish to have the notes which she herself gave. If she wishes to make such a request, it would be helpful if she could let the Tribunal know in the next 14 days so that that request to provide them can also be made of the Chairman at the same time.
