MR JUSTICE WALL

1. We took the view that the Appellant had an arguable case on appeal, that the Tribunal was wrong in law:

(1) in finding that there was a genuine redundancy;

and

(2) in ignoring the absence of any evidence of a proper consultation/selection process for redundancy.

2. There were four engineers at the "Crown Agents" site: the Appellant was the only one apparently made redundant, and this despite the fact that the "Crown Agents" contract did not come to an end and was renewed.
