  1. This matter comes before us for an application for review of the decision of this Employment Tribunal on 15 June 2001. The decision of the Employment Tribunal on the Preliminary Hearing heard on that date proceeded in the absence of the Appellant.
  2. The Appellant protested and complained that she had not had proper notices from the Employment Appeal Tribunal staff and she applied for a review because she wished to be heard in person on her appeal.
  3. Having considered all the factors this Tribunal allowed that application, believing that the Appellant may have misunderstood the position and were prepared to review the original decision in which the appeal was dismissed. However, today, the day listed for that Preliminary Hearing, has begun by the Employment Appeal Tribunal receiving a faxed notice from the Appellant, that she is not proposing to attend.
  4. Accordingly we proceed on the basis that we review our original decision by confirming it on the basis that the Appellant has not attended or advanced further argument. The appeal remains dismissed.
