It is ordered:-

1.     Pursuant to rule 8(3)(a), the appeal is struck out.

 

REASONS

1.            I have considered whether to hold a hearing to enable submissions to be made about possible strike out but consider it disproportionate to do so.

2.            By GRC1 dated 02 July 2024, Amjid Dad sought to appeal a decision of the Driver and Vehicle Standard Agency which he says was made on 19 June 2024.

3.            In Case Management Directions dated 11 December 2024, Legal Officer F Haji required Amjid Dad to provide a copy of the decision by 30 December 2024. Nothing has been received by the Tribunal Office. He was warned that, if he did not comply with the direction his appeal could be struck out under rule 8(3)(a) of the GRC Rules.

4.            Whilst rule 22(e) does not require an appellant to provide a copy of the decision, but merely to provide “details of the decision or act, or failure to decide or act, to which the proceedings relate”, it is of concern that Amjid Dad failed to comply with a clear direction of the Tribunal.

5.            I consider the following to be clearly relevant: the decision is said to have been made on 19 June 2024, the appeal is dated 02 July 2024 and the Directions of the Legal Officer were made in December 2024. It is now April 2025 and, it would appear, that Amjid Dad has not pursued this appeal in any way, for example by contacting the Tribunal to ask about progress.

6.            Rule 8(5) provides that Amjid Dad may apply for reinstatement of the appeal, such application will need to be made using form GRC5 and that form should explain why Amjid Dad has not pursued this matter by asking for any update or set out the ways by which an update was requested. The decision of Driver and Vehicle Standard Agency made on 19 June 2024 should be enclosed with any application for reinstatement.
