Jane Ryan v Bridget Murphy (Alteration and rectification of the register : Mistake) [2018] UKFTT 440 (PC) (31 July 2018)


[2018] UKFTT 440 (PC). The dispute was over the ownership of a passageway/hallway between two adjoining cottages. Both titles appeared to show that the passageway formed part of R-™s title. A applied to alter her title to remove the note on the property register apparently excluding the passageway from her title. A was successful. There was a clear mistake caused in part by the existence of a flying freehold over part of R-™s title and in part by a complex conveyancing history.
