Decision notes [2019] UKFTT 103 (PC). The sale of a number of properties which had formed part of a farm led to a dispute about the size of the area allocated to one property for parking. The applicant applied to remove land from the respondent’s title. The area marked out on the ground (and used for parking) did not accord with the conveyance plan. No claim for adverse possession was made. The case turned on the construction of the conveyance plan. The area to be used for parking was clear. The application for alteration was refused on the grounds that making the alteration would serve no practical purpose.
