Decision notes [2019] UKFTT 105 (PC). Claim for adverse possession of rough ground adjoining Applicant's late parents’ property, recently inherited by him. Respondents were adjoining owners who did not claim the property for themselves. The land had been enclosed by Applicant in 2016 but prior to that had been open to all. His access to the land had previously been obtained through a gap in his garden fence or by lifting a fence panel. Applicant unable to establish exclusive factual possession or an intention to possess.
