Decision notes [2019] UKFTT 592(PC). Applicant resides on a houseboat which is moored on a river within the curtilage of the property - whether or not he was the lessee of part of the property - whether, on first registration, the freehold would be subject to a lease. HELD that the lease was void for want of registration and that the Applicant’s estate contract arising under section 7 of the Land Registration Act 2002 was void as against a purchaser of the property for money or money’s worth by virtue of sections 2 and 4 of the Land Charges Act 1972. Accordingly, the freehold is not subject to a lease.
