Summary: The complainants are a firm of solicitors representing clients who are in dispute with the council over their house. The house is close to the intended route of a new section of road and the clients are concerned that this will adversely affect their enjoyment of, and the value of their property. The council provided some of the client-™s personal data to the complainants in response to their request under section 7 of the Data Protection Act 1998 (the -˜DPA-™). However it withheld other information on the basis that section 40(2) of the Act applies, and other information on the basis that Regulation 12(4)(e) of the Environmental Information Regulations 2004, (internal communications) applies. Section 40(2) refers to the personal data of third parties. Information Tribunal appeal EA/2011/0099 withdrawn.
