Summary: The complainant made a request to the Qualifications and Curriculum Development Agency (QCDA) for information relating to Testbase software which was created by a company called Doublestruck which contains past examination questions obtained by Doublestruck from QCDA. QCDA refused to provide this information to the complainant as it stated it was exempt from disclosure under section 43(2) of the Freedom of Information Act 2000 (the -Act-). The Commissioner considers that the section 43(2) exemption was correctly engaged in this case.
