Summary: The complainant requested details of the council legal action and deliberations about a landowner-™s activities in Dunnington in the East Riding of Yorkshire. The council refused the request on the basis that the exceptions in Regulations 12(4)(e) (internal communications) and 12(5)(b) (course of justice) applied. The Commissioner-™s decision is that East Riding of Yorkshire Council has correctly applied the exceptions to the majority of the information. However the Commissioner has decided that one section of information which the council excluded from the scope of the request did fall within its scope. He has however decided at his own discretion, that Regulation 13 applies to this information (personal data).
