Summary: The complainant has requested information relating to a complaint he made to Northumberland County Council. The Council refused the request under section 40(2) of the FOIA. The Commissioner-™s decision is that the Council was entitled to rely on section 40(2) in relation to third party personal information. The Commissioner also finds that the Council should have cited section 40(5) in relation to any information held which is or would be the complainant-™s personal information. The Commissioner does not require the Council to take any further steps to ensure compliance with the legislation.
