The complainant has requested information regarding advice North Yorkshire County Council (NYCC) received regarding the exclusion of a particular bus service from the English National Concessionary Travel Scheme. NYCC has withheld the information which it says is exempt from disclosure under section 42(1) of the FOIA (legal professional privilege). The Commissioner’s decision is that: NYCC has correctly applied section 42(1) to the information because it is subject to legal professional privilege; and that the public interest favours withholding the information. He does not require North Yorkshire County Council to take any steps.
